Um policial militar foi condenado pela Auditoria Militar do Ceará, da Justiça Estadual, por se apropriar de um aparelho celular de um torcedor de futebol, em uma abordagem a um ônibus em Fortaleza. O caso aconteceu em setembro de 2019.

O soldado Edson Reinaldo dos Santos foi sentenciado a três anos de reclusão, em regime aberto, pelo crime de peculato, em sentença proferida no último dia 7 de abril. Segundo o artigo 303 do Código Penal Militar (CPM), peculato significa “apropriar-se de dinheiro, valor ou qualquer outro bem móvel, público ou particular, de que tem a posse ou detenção, em razão do cargo ou comissão, ou desviá-lo em proveito próprio ou alheio”. A pena pode variar de três a cinco anos de reclusão.

De acordo com a sentença judicial, composições da Polícia Militar do Ceará (PMCE) abordaram um ônibus na noite de 22 de setembro de 2019 – depois do jogo Fortaleza x Palmeiras pelo Campeonato Brasileiro – e mandaram cerca de 40 torcedores descerem do transporte, na Avenida Sargento Hermínio, no bairro Monte Castelo, em Fortaleza.

Um torcedor deixou um smartphone e a carteira dentro do ônibus e, após a revista policial, voltou ao transporte para pegar os pertences, mas não encontrou o celular. Um Boletim de Ocorrência (BO) foi registrado no 1º DP (bairro Ellery), da Polícia Civil do Ceará (PC-CE).

Os investigadores oficiaram a operadora de telefonia, que informou que o aparelho celular havia trocado de chip no dia 23 de setembro daquele ano. O novo número foi cadastrado justamente no nome do soldado Edson Reinaldo dos Santos, que participou da abordagem policial ao grupo de torcedores.
